Job Description

Purpose/Objective

    Carry out all activities as per statutory compliances, rules and regulations to minimize future liability and risk for the company. Legal Risks in land acquisition & project development including RERA & Companies Act statutory compliances.

Key Responsibilities of Role

    Support functional teams in land acquisition process by providing guidance in negotiations on legal matters to mitigate potential legal risks. - Conduct preliminary and detailed due diligence for every prospective acquisition and ensure it is conducted in a timely manner with due consideration of all legal aspects and legal risks. - Support finance team by vetting fund-raising documents and negotiating with banks, NBFCs and Private Equity firms on legal matters. - Conceptualize and subsequently detail the legal structures to implement projects. - Engage with business development team to address legal queries in Joint Ventures and land acquisition agreements and negotiations with land owners. - Manage relations with solicitors for timely documentation of the agreements. - Ensure finalization and standardization of legal documentation for all transactions. Devise litigation strategy & lead litigation cases with external lawyers and advocates to minimize legal liability and achieve case resolution at the desired pace. - Manage investigation for the litigation cases and scrutinization of the related documents. - Oversee appointment and negotiation of Senior counsel, counsel, advocates etc. for addressing litigation cases. - Support external advisors by providing accurate data related to the litigation. - Manage cost incurred during litigation and ensure overall cost is within defined budget. - Support team for preparing legal notices, suits, legal replies, briefs for legal advisers/solicitors. To manage all legal clearances, compliances (including RERA) to ensure projects are launched as per tracker timelines & Support operations team for specific projects on legal matters to ensure legal compliances and avoid any future risk. - Ensure that the internal teams provide complete & accurate information for RERA filing. - Ensure all legal compliance under Company law, land legislation, environment laws etc are complied with during project design and launch. - Support operations team for addressing any legal issue raised by government / private bodies during project implementation. - Ensure legal vetting of all marketing and sales communication documentation viz. brochures, application allotment, customer letters and project approvals. - Ensure issues raised by the customers are addressed on time. - Ensure registration of trademark. - Support in creation of Legal FAQs for the sales & CRM team. Develop a capable and motivated team to achieve better results. - Conduct training session for keeping team abreast with the latest rules and regulations. - Conduct performance appraisals, assess capability and training needs of individuals in the function. - Develop career plan for the employees by providing guidance and motivating them for achieving functional targets. To ensure all legal compliances are adhered to for Organization operations and there is no legal & financial risk on account of non-compliance / delay in compliance. - Vet all contracts/agreements from legal recourse. - Provide input from legal perspective to provide insulation to the firm. - Coordinate with law firms/solicitors for inputs on addressing legal matters. To design & implement legal framework for compliance in the Organization & design internal processes & controls for deal evaluation and handling and tracking of legal matters in the most efficient manner. - Ensure business operations adhere to Organizational legal policies, all national and regional real estate laws. - Develop annual operating plan and budgets according to the scheduled projects for the year. - Establish the standards of compliance and evaluation for land acquisition. - Train the team members in usage of processes & controls. - Liaise with law firms and solicitors for long term partnership.

Qualifications and Experience

    Education - Full-Time LLB Degree. General Experience: - Around 15 years of relevant experience. - Must have knowledge of Haryana RERA. - Candidate must be residing in Gurgaon, Faridabad, South or West Delhi only.
