Position Overview:
We are looking for an experienced Legal Head to oversee the legal function for our Residential Segment. This role will involve ensuring compliance, managing legal risks, and providing strategic legal guidance to support residential development goals. The Legal Head will collaborate across functions to align legal strategies with business objectives, driving growth and mitigating risks.
Land Title and Ownership:
- Conduct and review title searches, title reports, property deeds, conveyance deeds, and other relevant documents.
- Ensure clear and marketable title for all residential properties.
- Identify and proactively mitigate title-related risks.
RERA Compliance:
- Ensure strict adherence to the Real Estate (Regulation and Development) Act, 2016 (RERA).
- Accountable for project registration, maintenance, and documentation filing under RERA requirements.
- Conduct RERA audits to maintain full compliance and address any compliance issues.
Documentation:
- Prepare and review term sheets
Draft, review, and negotiate contracts, including:
- Joint Development Agreements (JDAs)
- Joint Venture (JV) agreements
- Buyout agreements
- Development agreements
- Construction contracts
- Lease Agreement
- Definitive documents
- Sales and purchase agreements
- Prepare and review term sheets, definitive documents, joint venture agreements, development agreements, lease agreements, sale and purchase agreements.
Regulatory Approvals:
- Coordinate with SRA (Slum Rehabilitation Authority) for necessary approvals.
- Liaise with MHADA (Maharashtra Housing and Area Development Authority) for approvals and compliance.
- Interact with Heritage Committee for preservation and development of heritage properties.
- Collaborate with High Rise Committee for approvals and compliance.
Deal Structuring:
- Advise on deal structuring for residential development projects.
- Draft, review, and negotiate contracts, including JDAs, JVs, and buyout agreements.
- Conduct due diligence on potential partners and vendors.
Negotiations:
- Negotiate with stakeholders, including landowners, developers, and authorities.
- Resolve disputes and facilitate settlements.
- Litigation Management: Manage and coordinate litigation related to residential development projects.
- Risk Management: Identify and mitigate legal risks associated with residential development projects.
Leadership and Cross-functional Collaboration:
- Lead and mentor a team of legal professionals, fostering a culture of collaboration and high performance.
- Work closely with cross-functional teams, including Project Management, Sales, Finance, and Compliance, to align legal strategies with overall business goals
Dispute Resolution and Litigation:
- Handle pre-litigation and litigation matters concerning the residential development, collaborating with external legal counsel as needed.
- Manage disputes with clients, vendors, contractors, and other stakeholders, aiming for efficient, cost-effective resolutions
Policy Development and Training:
- Develop and update internal policies related to real estate law and regulatory compliance.
- Conduct training sessions for the residential segment team on legal, regulatory, and compliance-related topics.
Regulatory Compliance:
- Ensure compliance with Indian real estate development laws and regulations, including local Mumbai-specific regulations.
Risk Management:
- Proactively identify and mitigate legal risks associated with residential development projects.
Desired Skills & Experience:
- 15+ years of experience in real estate law.
- LL.B. from a reputable law school in India.
- Registered with the Bar Council of Maharashtra.
Expertise in:
- Land title and ownership laws
- RERA regulations
- SRA, MHADA, and Heritage Committee guidelines
- High Rise Committee approvals
- Deal structuring and negotiations
- Contract law
- Litigation management
Additional Requirements:
- Familiarity with Mumbai-specific regulations and real estate laws.
- Strong analytical and problem-solving skills.
- Knowledge of Indian court procedures and litigation.
- Ability to thrive in a fast-paced, high-growth environment with a solutions-oriented mindset.
- Proven track record of implementing risk mitigation strategies.
- Experience with government relations, community engagement, and public-private partnerships is advantageous.
