Hiranandani Financial Services - Litigation Manager (5-10 yrs)

- We are seeking a Litigation Manager to oversee legal recovery processes, case management, and compliance in Powai.

- The role involves implementing legal strategies, managing litigation procedures, and fostering relationships with law enforcement, courts, and legal entities to maximize recovery efforts.

Roles and Responsibilities

Legal Recovery & Case Management:

- Implement legal recovery objectives and assist collections teams in enhancing recovery efforts.

- Maintain an up-to-date legal MIS and ensure proper tracking of all legal proceedings.

- Draft and review legal notices, replies, and other legal communications.

- Oversee litigation procedures, including SARFAESI, Section 138, Arbitration, Executions, and Civil/Criminal cases.

Court Representation & Legal Compliance:

- Represent the company in courts, tribunals, and arbitration proceedings.

- Collaborate with law enforcement agencies, courts, and external legal advisors for timely case resolution.

- Ensure compliance with all legal regulations and develop strategies to minimize legal risks.

Stakeholder Management & Cost Optimization:

- Build and maintain strong relationships with lawyers, solicitors, and legal firms in the region.

- Utilize legal mechanisms such as Lok Adalat, conciliation, and debt recovery tribunals to facilitate collections.

- Initiate projects aimed at reducing legal costs and improving the efficiency of legal proceedings.

Customer Engagement & NPA Management:

- Conduct customer visits for stressed/chronic borrowers to negotiate legal recovery solutions.

- Execute Section 14 procedures for asset recovery and ensure compliance with enforcement actions.

- Address non-performing assets (NPAs) and develop customized solutions to maximize recovery.

Skills & Qualifications Required:

- Education : LLB or equivalent law degree.

- A specialization in banking and financial law is preferred.

- Experience: 5-10 years of experience in litigation, legal recovery, and collections management within NBFCs, Banks, or Financial Institutions.

- Legal Expertise: Strong understanding of SARFAESI, Arbitration, Section 138 (Cheque Bounce), Civil & Criminal Litigations.

- Negotiation & Communication: Ability to negotiate settlements, interact with legal entities, and represent the company in court.

- Case Management & Documentation: Experience in maintaining legal case databases, drafting legal documents, and ensuring compliance with regulatory frameworks.
