Role & responsibilities

I. Checking the Title of the Properties:

1. Reading 7/12 Extract

2. Reading and understanding Mutation Entries

3. Property Card

4. Kami Jast Patrak

5. Pikpani Utara

6. Aakarfhod/Akarbandh

7. Revenue Village Form-8A

8. Reading and understanding Plans

9. Tracing Title- making Note, Flow Chart, Family Tree etc.

10. Calculation of Area

11. Reading Notification e.g. SRA (Slum Gazette Notification)

12. Issuing Public Notice

13. Reply to objection received regarding Public Notice

14. Checking litigation

15. In death cases - checking Death Certificate, Probate/Will-details of heirs

16. Checking Address/PAN Cards, age details of Vendor

17. Reading POA's if given by Vendors

18. Checking the legality and validity of documents

19. Checking previous Title Documents

20. Due Diligence of the title documents and revenue records of the Land and preparing of preliminary title report.

21. Drafting of Sales Related Documents such as Reservation Application Form, Allotment Letter, Agreement for Sale as per RERA, Updating the Project Details Quarterly on RERA Website and research on RERA Orders, Circulars, Government Notification, and High Court Orders.

22. Drafting of Written Submissions, Affidavit in Reply in the RERA Complaints. Reviewing and Finalizing of the Replies, Written Submissions, Chamber Summons, and Writ Petitions received from the external advocates

II. Co-ordination with various departments like Liaisoning, Matrix, Finance, Accounts, Administration, Company Secretary, Solicitors. Coordinating with the internal and external advocates for the matters filed by or against the company.

III. Calling for Stamp Paper

IV. Co-ordination for Board Resolution

V. Drafting various type of documents like,

1. RERA Agreements

2. Development Agreement

3. Deed of Conveyance

4. Building structure conveyance and land conveyance after society is formed.

5. Joint Venture Agreement

6. Memorandum of Understanding

7. Deed of Rectification

8. Cancellation Deed

9. Supplementary Deed

10. Confirmation Deed

11. Declaration-cum-Indemnity

12. Partnership Deed

13. POA- General and Special

14. Receipt

15. Allotment Letter, Possession Letter, Other Letters

16. Agreement for Sale

17. Lease Deed/Leave and License Agreement

18. Letter of Intent

19. Resale Agreements

20. Other Agreements

21. Reservation Form

VI. Customers Query:

1. Replying to the queries by Sales/CCD Department

2. Replying to Customer Queries

3. Drafting various types of letters/replies to the Customers;

VII. Drafting Customer Care Letters

VIII. Correspondence with Municipal Corporation of Greater Mumbai (MCGM) and other Public/Government/Semi-Government Authorities

IX. Knowledge of SRA, RERA/Real Estate Laws/Property Law

X. Research on Property Law/RERA judgments/orders/notices/circulars, updating and advising the Company on the amendments/new requirements and incorporating them in standard drafts or creating new drafts as required by RERA.

XI. Although the drafting will be done in English language, the candidate should be able to understand, read and write Marathi in order to check the title of property. Should be able to read and understand the Marathi Agreements, revenue records, mutation entries etc.

XII. Should be able to independently do the basic checks / coordination and independently draft various Agreements and contracts.

XIII. Declaration cum Indemnity, Undertaking, Demand Letter, Reminder Letter, Possession Letter, Termination Letter, Deed of Cancellation,

Deed of Rectification, Leave and License Agreement and other related documents.

  1. Drafting of Tenants related documents such as Agreement for Transfer of Tenancy, Power of Attorney, Declaration cum Indemnity and related documents for the redevelopment projects &
  2. documents relating to Industrial Land Transactions such as Letter of Intent, Memorandum of Understanding,
  3. Lease Deed, Sale Deed, and Confidential Agreement. Attending meetings and finalizing the documents with the clients and their counsels.

  6. Drafting of Legal Notices, replies to the Legal Notices, Letters/Complaints to concerned authorities, Deed of Conveyance and Memorandum of Understanding for sale of NA Plot for the Project.
