Position Overview:

We are seeking an experienced and strategic leader for the position of Manager Contracts (Overseas) at Ashoka Buildcon Limited for our international projects. This role involves overseeing all aspects of contract administration, ensuring compliance, managing disputes, and facilitating seamless project administration from start to finish. To provide expert guidance on all forms of contracts including FIDIC, ICC, JCT and NEC-based contracts and lead high-stakes dispute resolution and arbitration efforts, particularly for international infrastructure projects.

Key Responsibilities:

• Strategic Contract Management: Oversee the full contract life-cycle, from drafting, negotiation, and award to administration, closeout, and post-contract analysis, to improve processes and ensure efficient project delivery.
• Contractual Notices and Responses: Oversee the preparation and final drafting of contractual notices and responses to support timely communication and compliance with project stipulations.
• Extension of Time Management: Ensure projects secure necessary extensions of time, coordinating with project teams and legal advisors to substantiate claims for delays and related project impacts.
• Dispute Resolution & Arbitration: Serve as the companys authority on dispute management, leading arbitration and alternative dispute resolution (ADR) processes in international projects to safeguard company interests. Partner with legal teams and external consultants for efficient claim settlements.
• Document Review and Finalization: Review and finalize critical contractual documents including MoUs, confidentiality agreements, sub-contract agreements, JV agreements, and service provider agreements, ensuring all terms align with company goals and regulatory standards.
• Contractual Closeout & Compliance: Lead successful closeouts of contracts, ensuring compliance with legal standards and best practices managed under all forms of contracts.
• Team Development & Mentorship: Develop and mentor a team of contract administrators and managers, fostering growth and upskilling in contract management principles, dispute resolution, and negotiation techniques.
• Stakeholder & Client Relationship Management: Act as the primary liaison for all contract-related interactions with clients, subcontractors, and project stakeholders, maintaining strong relationships and facilitating clear, consistent communication.
• Risk Management & Mitigation: Develop proactive risk identification and mitigation strategies. Review contracts to minimize exposure to liabilities and ensure that risk management processes align with corporate governance.
• Cost & Claims Management: Monitor project budgets related to contract management and oversee claims preparation, defense, and negotiation to ensure justifiable reimbursements and minimize losses.
• Continuous Improvement & Best Practices: Develop and implement improvements to contract management processes, promoting consistency, efficiency, and alignment with international best practices.

Qualifications and Experience:

• Education:
• Bachelors Degree in Civil Engineering (BE/B.Tech Civil).
• Postgraduate specialization in Contract Management from NICMAR/RICS.
• Additional Qualification: LLB or LLM is desirable.
• Experience:
• Construction Industry Experience: 20 years of experience, with a significant focus on large-scale infrastructure projects.
• Contract Management Expertise: At least 08-10 years in a similar role, with proven expertise in international project contract administration under FIDIC, ICC, JCT and NEC frameworks.
• Project Closeout & Claims Management: Demonstrated success in the contractual closeout of at least 8 international projects, including claims and arbitration.
• Dispute Resolution & Arbitration: Extensive experience in handling international disputes and arbitration, with a strong record of favorable outcomes in at least 2 International Arbitrations.
• Technical Skills:
• Legal Acumen: Strong working knowledge of construction contract law, international dispute resolution standards, and arbitration processes.
• Risk Analysis & Mitigation: Skilled in identifying and mitigating contractual risks.
• Process Improvement: Knowledge of best practices in contract management and project governance.

Key Skills and Competencies:

• Contract Knowledge: In-depth understanding of FIDIC, ICC, JCT and NEC contractual terms and conditions.
• Analytical and Problem-Solving Abilities: Strong analytical and strategic thinking skills for high-impact decision-making.
