We are seeking an experienced and highly skilled Legal Head - Real Estate with 18-20 years of experience in real estate law. The ideal candidate will have a strong background in legal compliance, property transactions, land acquisition, litigation, and regulatory matters related to real estate. The role requires leadership in managing legal risks, ensuring regulatory compliance, and supporting business objectives.
Key Responsibilities:
- Title Due Diligence: Conduct detailed title verification for properties, ensuring clear title ownership and identifying potential risks or encumbrances. Review and analyze title deeds, encumbrance certificates, revenue records, and other relevant legal documentation. Coordinate with external legal advisors, surveyors, and government authorities for accurate title clearance.
- Land Acquisitions: Draft, review, and negotiate contracts related to land acquisitions, including sale deeds, lease agreements, joint development agreements (JDAs), and power of attorney (PoA).
- Ensure compliance with local, state, and central laws governing property transactions. Handle legal due diligence during acquisitions, including verification of zoning, land use, and regulatory approvals.
- Regulatory Compliance: Liaise with regulatory authorities to obtain approvals, permits, and licenses for real estate projects. Ensure compliance with RERA (Real Estate Regulation and Development Act) and other applicable regulations.
- Dispute Resolution: Handle property-related disputes, including litigation and arbitration, in coordination with external counsel. Provide legal opinions on potential disputes and recommend mitigation strategies.
- Stakeholder Management: Collaborate with cross-functional teams, including project management, finance, and operations, to address legal concerns in real estate projects. Serve as a key point of contact for legal queries related to land acquisition and real estate matters.
- Legal Documentation and Record Management: Maintain accurate legal records and title documents for all property transactions. Develop and implement processes to streamline documentation and compliance tracking.
