Job Description

Job Summary:

The Pan India Head Contracts will oversee all contractual functions for real estate projects across the country. This strategic leadership role involves managing the end-to-end tendering process, contract negotiations, vendor management, and risk mitigation. The position ensures alignment with organizational objectives, legal compliance, and cost-effectiveness, contributing to the successful execution of real estate projects.

Key Responsibilities:

1. Tendering and Bid Management:

  • Lead the end-to-end tendering process, including preparation, evaluation, and finalization of tenders for contractors, consultants, and suppliers.
  • Develop comprehensive Request for Proposal (RFP) and Request for Quotation (RFQ) documents tailored to project requirements.
  • Evaluate bids and proposals, ensuring technical and financial alignment with project objectives.
  • Participate and closely monitor the tendering process and initiating commercial discussions
  • Negotiate, Finalize & Award alternate Contracts. Handle the entire Tender Cycle
  • Conduct pre-bid meetings and provide clarifications to bidders.

2. Contract Drafting and Negotiation:

  • Review of Breakdown of BOQ - Pre-Contract & Post - Contract Award
  • Draft, review, and negotiate contracts for construction, procurement, consultancy, and vendor services.
  • Ensure contract terms are legally compliant and commercially favorable.
  • Manage amendments, variations, and renewals of existing contracts.

3. Pan-India Coordination:

  • Collaborate with regional and project teams to address localized challenges in tendering and contracting.
  • Standardize tendering and contracting processes across all regions to ensure consistency and efficiency.

4. Vendor and Stakeholder Management:

  • Develop and maintain a robust network of contractors, vendors, and consultants.
  • Manage contractors and ensure that all contractual responsibilities are met, including identifying risks and managing performance.
  • Ensure that contractors subcontracting arrangements are supported by written subcontracts, and only hire a subcontractor who possesses the requisite abilities and resources to safely complete the task within the scope of the subcontract.
  • Identify & Shortlist best possible Contractors by studying their Capacities & Capabilities.
  • Ensure contracts compliance with contractual terms & conditions, highlight any gap
  • Evaluation & Response to Contractual Claims.
  • Evaluate vendor performance and ensure adherence to contract terms and project timelines.
  • Build strong relationships with internal stakeholders to align tendering and contracting strategies with organizational goals.

5. Risk Management and Compliance:

  • Identify and mitigate risks associated with tendering and contractual processes.
  • Ensure compliance with legal and regulatory requirements, including RERA, environmental norms, and local by-laws.
  • Handle disputes and claims, working closely with legal teams and external counsel when required.
  • Review & propose necessary contractual amendments to the draft conditions of contract
  • Liaise with Accounts for payment recommendations
  • Review contracts, analyses, mitigate risk, and prepare time cost claims.
  • Evaluate Claims, Negotiate & Finalize Variation Work Amendments
  • Coordinating with Planning Team to identify the Project Timelines & Deliverables.

6. Cost Control and Optimization:

  • Ensure cost-effectiveness by negotiating favorable terms with vendors and contractors.
  • Monitor budgets and control costs across all tendering and contracting activities.
  • Coordinating with Cost Management Team for detailed Project Budgeting.
  • Coordinating with Design Team to ensure Contract Package Tenders are released on time.
  • Identify levels for negotiations and lead commercial interactions to award Contracts as per Project Plan.

7. Team Leadership and Development:

  • Build and lead a high-performing team of professionals in tendering and contract management.
  • Provide training and mentorship to ensure the team stays updated on industry trends, legal requirements, and best practices.
  • Foster a culture of excellence, accountability, and collaboration.

8. Performance Monitoring and Reporting:

  • Establish KPIs to measure the efficiency and effectiveness of tendering and contracting processes.
  • Regularly report to senior management on key metrics, including cost savings, vendor performance, and risk mitigation efforts.
