RESPONSIBILITIES & TASKS:
Pre Acquisition activities :
- Conducting and Overseeing legal due diligence and highlight the legal aspects of documentation, security creation (mortgage, pledge etc.), etc
- Supporting NPA acquisition team in addressing various legal issues, assisting (including guiding juniors of legal team) in litigations before forums such as DRT, DRAT, NCLT, NCLAT, High Court, other courts.
- Liasoning with outsourced agencies and advise them about the requirements of the company.
- Post Acquisition activities :
- Assisting and advising teams regarding execution of assignment agreements and registration of the same, for modification of charges on assets of the borrowers in favour of the company and perfecting security in favour of the Company
- Initiate and follow up on legal action against borrowers for speedy recovery and assist the resolution teams in implementing resolution strategies from the legal stand point.
- Liasoning with and advise lawyers and other firms for taking forward litigations filed by seller banks before various courts and tribunals and any other forums as also on proceedings required to be initiated.
- Assisting to defend the company and liaison with counsels, lawyers and firms. Further, putting up the view point and briefing them and preparing case for opinions for law firms/ counsels.
- Providing assistance and law points to the resolution team on the approaches to be adopted before Courts and NCLTs. Be updated with amendments and latest laws and important judgements.
- Assisting and advising the resolution team on initiating action under the Recovery of Debts and Bankruptcy Act, 1993 (DRT Act), SARFAESI Act and assist in making applications for taking possession before the CMM / DM, to assist the authorised office in taking possession of secured assets, to draw up requisite panchnamas and comply with other formalities required under the SARFAESI Act.

- Knowledge of Statutory/Regulatory Compliance
- Companies Act, 1956 / 2013
- DRT Act and Sarfaesi Act, Transfer of Property Act, Negotiable Instruments Act, Indian Contract Act & Insolvency & Bankruptcy Code, 2016 (IBC)
- Essential
- Reasonable exposure to financial loan documentation and litigations (case laws) for recovery of loans pursuant to actions taken under DRT Act, SARFAESI Act & IBC Desirable
PERSONAL CHARACTERISTICS
- Communication skills - logical and organised thoughts and clear and concise articulation
- Ability to work effectively with different divisions within the group in a matrix reporting structure
