Job Description

We are seeking a knowledgeable and experienced Real Estate Enthusiast and Property Acquisition Specialist to join our team. The ideal candidate will have in-depth expertise in property laws, auction processes, and legal frameworks related to financial institutions, including PSU banks, private banks, and tribunals such as DRT and NCLT. The role requires a strong understanding of the SARFAESI Act, Transfer of Property Act, and documentation involved in property transfers.

Key Responsibilities:

SARFAESI Act & Recovery:

*Provide expert advice on the SARFAESI Act and assist in enforcement actions under the Act.

*Ensure compliance with legal requirements for recovery processes and asset auctions.

Property Auction Processes:

*Handle the end-to-end property auction processes of PSU banks, private banks, and other financial institutions.

*Liaise with banks and tribunals to manage auctions, bid processes, and ensure adherence to regulatory requirements.

Legal Documentation & Property Transfers:

*Review and draft legal documents related to property transfer, including sale deeds, title transfer documents, and agreements.

*Ensure accuracy and legal validity of property documents.

Tribunal Process:

*Represent the organization or clients in tribunals like DRT (Debt Recovery Tribunal) and NCLT (National Company Law Tribunal) for recovery and auction-related matters.

*Prepare legal documentation and arguments for tribunal cases.

*Compliance & Legal Advisory:

*Ensure compliance with relevant laws, regulations, and procedural requirements.

*Provide legal opinions and advisory support related to property laws and financial recoveries.

Experience:

Minimum of 3 years experience in handling property auction processes, banking law, and tribunal cases.

Hands-on experience with the SARFAESI Act and Transfer of Property Act.

Skills:

Strong understanding of legal frameworks related to property transfers.

Proficiency in drafting and reviewing legal documents.

Excellent communication, negotiation, and analytical skills.

Ability to handle tribunal representations independently.

*Preferred Qualifications:

*Education: Bachelors or Masters degree in Law- BA,(LLB/LLM).

*Knowledge of insolvency proceedings under IBC (Insolvency and Bankruptcy Code).

*Prior experience working with PSU banks, private banks, or financial institutions.

*Familiarity with legal tech tools and software. AUCTION PORTALS AND TRIBUNALS PROCESS AND FUNCTIONING

*Experience in Legal Recovery will be preferred.

Desired Candidate Profile

• Strong understanding of Indian Contract Act, Transfer of Property Act, RERA regulations, Sarfaesi Act, and other relevant laws governing the real estate sector.
  
• Excellent drafting skills for preparing agreements and legal documentation.
  
• LLB degree from a recognized university; LLM preferred but not mandatory.
  
• 3-6 years of experience in real estate law or a related field (property acquisition).
