ANI v. Open AI: Time to Talk About ‘Machine Unlearning’
- ANI has sought an interim injunction against OpenAI that would prevent it from reproducing or publishing its copyrighted material in any manner, including through the ChatGPT model.
- ANI also seeks to disable ChatGPT from accessing ANI's works published by them or through their subscribers. Technical and legal problems might occur with implementing the interim injunction sought by ANI against OpenAI.
- To ensure that Gen AI models are compliant with laws regarding Copyright and safety, machine unlearning is seen as a technical intervention that can be employed to purge models of unwanted information.
- There are mismatches and gaps between technical unlearning methods and policy goals, leading to over and under-inclusiveness issues. Thus, machine unlearning is not a sure-shot way of ensuring that a model does not engage in infringing behavior.
- Removing data from a GenAI model is not easy since its internal structure is way more complicated. Also, machine unlearning methods do not support long-standing copyright doctrines, such as the idea-expression dichotomy.
- ANI's case against OpenAI highlights the need to discuss the possible limits of machine unlearning, especially in the context of news reporting - it is quite possible that another news source might report on the same facts, and the model might generalize and produce a substantially similar output as that of ANI.
- It is unclear how the directions sought by ANI against OpenAI can be technically implemented. While framing the issues, the court noted that the copyrighted content in question is in the form of news.
- Machine unlearning is a subarea of machine learning that develops methods for the removal of the effect of training data and the suppression of content in generative-AI models.
- Purging information from a GenAI model is not similar to removing data from a database, making it difficult to make a model behave.
- The court has suggested that both OpenAI and ANI during the trial can answer whether unlearning copyrighted content during model training is technically and practically feasible.
