1) Advising business on tax impact from Customs perspective on cross border transactions, in particular, import of goods into India from various countries.
2) Correct determination of HS Codes (HSN) under Customs Tariff and advising business on assigning / maintenance of codes properly while filing Bill of Entry and validating the same also in SAP Masters.
3) Determining effective rates of different types of customs duties with respect to classification adopted for goods imported by the company and advising business on any conditionalities attached for getting any tax concessions and suggesting appropriate processes for compliances thereto.
4) Review of classification adopted in case of goods imported in the past and suggest changes wherever required.
5) Responsible for customs valuation (including handling the Special Valuation Branch proceedings), Country of Origin, Permit/License application, Customs Privileges e.g. MOOWR Scheme, Free Trade Zone /Bonded Facilities etc.
6) Suggest measures for importation of goods under various schemes of Foreign Trade Policy, Advance Authorizations, EPCG, Free Trade Agreements etc., so as to take optimum tax benefits wherever possible.
7) Collaborating with various touchpoints such as Customs House Agents, freight forwarders/ transporters, CFS, Customs Warehouse etc. in relation Customs compliance activities, including activities related to E-waybill compliances.
8) Proactively identify value-added opportunities to improve trade duty competitiveness, minimize compliance risks and reduce costs.
9) Proactively identify trade-related regulatory changes and ensure that policy/process updates are made, communicated, and implemented.
10) Assist in external audits & manage relevant certifications and licenses (AEO)
11) Support and conduct risk assessments to identify compliance concerns and coordinate with appropriate partners to achieve the resolution.
12) Responsible for managing, handling, and mitigate existing and/or pending cases under litigation including Customs duty drawback, Bank Guarantee, EPCG, refund and tax demands under relevant schemes/ regimes including controversy and dispute cases.
13) Detailed scrutiny/examination of notices/letters, including show-cause cum demand notices issued by tax authorities related to Customs laws read-with Foreign Trade Policies, Free Trade Agreements/CEPA
14) Drafting replies to aforesaid notices/letters, submissions to be made in course of adjudication and other proceedings for their vetting by Sr. Leadership and attending Personal Hearing scheduled in the matters.
15) Wherever required, visiting offices of various departmental officers located in various Ports across PAN India for complying with various notices /letters etc.
16) Liaison/collaborating with Legal Counsels / Tax experts engaged by the company for any tax related issues.
17) Attending to / preparing draft appeals/submissions in any appellate proceedings in afore-stated matters before any authorities (eg. Commissioner-Appeals, Tribunal etc.)
18) Keeping track of the cases pending at various stages viz., inquiry/investigations, adjudication or appeal at various authorities and ensuring updation of records maintained for tracking of litigation
19) Rendering due support to tax compliance teams / collaborating with other departments internally for meeting any queries raised on afore-mentioned laws. This will include supporting the Channel Partners (Vendors, Customers etc) wherever advised/required.
20) Supervising the administrative activities rendered in course of above assignments such as tracking of Bonds/Bank Guarantees, arranging PoA/Letter of Authorisation, attending to Bills raised by Counsels and Vendors for various databases or similar services required in tax matters.
21) Should be able to delegate work / lead tax teams and / or tax professionals in managing the tasks at hand.
22) Creating SOPs for uniform business practice across PAN India and suggest internal checks & balances to be created from Governance point of view.
23) Creating MIS on Litigation topics, presentation to sr. leadership
24) Render due support on advocacy topics / representing issues before Govt. directly or thru Trade/Industry forums.
25) To impart training to internal / external stakeholders for ease of handling Customs compliances related work of the company
