The Head of Legal - Real Estate is responsible for overseeing all legal matters related to the company's real estate transactions and operations. This role requires a deep understanding of property law, real estate regulations, and corporate legal governance. The individual will work closely with senior management, external legal counsel, and various departments to ensure legal compliance and mitigate risks related to real estate acquisitions, developments, leases, sales, and financing.
Key Responsibilities:
Legal Strategy & Leadership:
- Develop and implement legal strategies to support the company's real estate objectives.
- Provide legal advice to senior management on all real estate matters, including acquisitions, developments, leasing, financing, and zoning laws.
- Lead the legal team in managing legal risks and ensuring regulatory compliance in all real estate transactions.
Transaction Management:
- Oversee all legal aspects of real estate transactions, including drafting, reviewing, and negotiating contracts, purchase agreements, lease agreements, and development agreements.
- Ensure all real estate documents are legally sound and compliant with local, state, and federal laws.
- Collaborate with finance, operations, and external counsel to facilitate smooth transactions.
Regulatory Compliance:
- Monitor and advise on regulatory changes related to real estate, land use, environmental law, zoning, and other relevant regulations.
- Ensure the company's real estate portfolio complies with all applicable laws, including corporate governance, environmental, and safety standards.
Dispute Resolution:
- Manage litigation and dispute resolution related to real estate transactions, including breaches of contract, landlord-tenant disputes, and construction-related claims.
- Work closely with external legal counsel when necessary to manage lawsuits and mediation processes.
Risk Management:
- Identify and mitigate legal risks associated with real estate transactions and operations.
- Advise management on potential legal risks, providing solutions to minimize exposure.
- Conduct due diligence for potential acquisitions or sales to identify legal risks.
Team Leadership:
- Lead and mentor a team of legal professionals, providing direction, performance management, and professional development.
- Manage relationships with external legal counsel and service providers.
Cross-functional Collaboration:
- Partner with the finance, operations, and development teams to ensure the legal interests of the company are adequately represented in all real estate matters.
- Act as the key point of contact for legal inquiries related to real estate for all internal departments.
Documentation & Record-Keeping:
- Oversee the preparation and maintenance of all real estate legal documents.
- Ensure that all transactions are properly documented, and records are maintained for compliance purposes.
