To, HR Department Duroflex World Pvt. Ltd. Bangalore Subject: Legal Notice for Workplace Harassment, Breach of Employment Terms, and Mental Agony Dear Sir/Madam, Under instructions from my client, Akash Santra, an employee of your esteemed organization, I am addressing this legal notice to bring to your attention the grave instances of harassment, breach of contract, and mental distress caused to my client due to your organization’s actions and the behavior of its employees. My client joined Duroflex World Pvt. Ltd. in August 2024 and has since experienced repeated incidents of unfair treatment, workplace harassment, and violations of agreed employment terms. These incidents include, but are not limited to: 1. Arbitrary Department Transfers: After completing training in the L1 department, my client was abruptly shifted to the SCM department without proper justification. Subsequently, on November 14, 2024, my client was pressured to either leave the company or move to a different department, citing reduced ticket volumes. 2. Unjustified Performance Warnings: On multiple occasions, including September 17 and November 18, my client received performance improvement warning emails without valid grounds. Such actions seem to be a deliberate attempt to create undue pressure and hostility. 3. Workplace Harassment: My client has been subjected to public insults, personal attacks, and unprofessional conduct by seniors and colleagues, including but not limited to Priyanka P, Haripriya, Shilpa, and Dhira Dhivakaran. This behavior has created a hostile work environment, significantly affecting my client’s mental and physical health. 4. Failure to Address Grievances: Despite repeated escalations and requests for intervention, managers such as Shilpa and Haripriya failed to provide any support or resolution. 5. Breach of Contract: My client signed a six-month employment contract, yet was asked to resign without prior notice or justification, causing financial instability and emotional distress. These actions collectively demonstrate a lack of adherence to professional ethics, employment laws, and contractual obligations. The treatment meted out to my client has led to severe mental anguish, health issues, and financial insecurity, for which your organization is directly responsible. Reliefs Demanded 1. A written apology acknowledging the harassment and unprofessional conduct within your organization. 2. Full and final settlement of all dues, including pending salaries, leave encashments, and any other financial obligations as per the employment contract. 3. Compensation of ₹52,400 for mental agony, harassment, and financial instability caused. 4. Immediate cessation of any further harassment or unfair treatment. Legal Recourse If my client does not receive a satisfactory response within 15 days from the date of receipt of this notice, we will be left with no alternative but to: File a complaint with the Labor Commissioner. Initiate civil and criminal proceedings for workplace harassment, mental torture, and breach of contract. Pursue all other legal remedies available under applicable laws. Company is no doubt growing, but its mid level managers and their arrogance causing trouble for the employees working under them. Lot of office politics, managers gives preference to only those employees who are licking there ***, not to those who genuinely work. There is lack of empathy all around, people should think from human angle as well, just to grow business they are taking everyone as machines. No work life balance, they upfront says don't take your job as 9-6 job. HR team is useless, they will make lot of policy but when it comes to apply them, they will simply say, check with your manager if they want apply or not. There are managers who have very good terms with upper level management, so they think they own the company and do whatever they feels like, no one can raise any complaint as well, as the person will have good terms with upper management.
