Result areas of the job

During Approval process:-

• To review approval text, Review of KYC of Partners, Legal and Security conditions point of view.
• To review loan and collateral documentation as to its compliance with the law and its enforceability in the local courts; ensure that the loan and collateral documentation is properly registered.
• Drafting and vetting of all legal documents in relation to the loans granted to the partners.
• To provide legal advice to the project officers during their due diligences/ KYC,
• To review of the loan documents pertaining to projects with production & services partners.
• To authorise disbursements for such projects.
• In addition to the previously mentioned tasks, the Consultant shall perform the following activities:
• review of loan proposals to be submitted at Credit Committee for approval to ensure the securities offered are enforceable (including subordinated loans),
• review of contract changes proposals submitted at Credit Committee for approval,
• review of Amendments to the loan documents,
• legal support and advice for Maanaveeyas borrowings,
• corporate housekeeping,
• any other support required from time to time from legal perspective.

During Legal Documentation (Post approval):-

• Review, suggest solutions and discuss on the loan documents to be executed by Maanaveeya while disbursements of the loans.
• To support and coordinate the process of loan documentation and disbursement.

Disbursement process:-

• Approval for documentation of the projects disbursements and to ensure quality and efficiency in preparation of legal documentation necessary to implement all Credit Committee loan decisions.
• To ensure that the loan and collateral documentation is properly registered with local authorities and LMS and within the Legal Safe file in Box;
• To support in providing the Legal clearance to Finance for disbursements

Portfolio Monitoring:-

• To prepare and maintain a tracking system for monitoring of charges created by our partners in favour of MV and also list of hypothecated loans etc.

Others:-

• Review and discussion of the loan documents executed by Maanaveeya while availing loans from various lenders in India.
• Drafting of various notes and providing opinion on various subjects matters pertaining to the business of Maanaveeya.
• To provide support in any other area as per the regional staff or HR team from legal perspective / as per the regional director´s or general counsels instructions.
• To keep up-to-date standard templates of legal documents, forms, standard procedures and policies for Maanaveeya and in coordination with the MV and OI Legal affairs or other departments and provide training to the regional staff on these areas. (e.g. recently on KYC policy of Oikocredit).
• To support in replying to Audit observations from time to time for Legal related observations.
• To support in co-ordination with OI Legal Affairs and Indian consultants/ third party for the compliance / legal related reports.
• To provide legal support to capacity building program and prepare contracts with external parties.
• To provide support in any other area as per the MD / CFO and Business Head instructions. Including coordinating with External Legal counsel and representing Maanaveeya in the court cases / disputes

Education and experience

• Graduate/Postgraduate in La
• Relevant work experience, minimum 8 years, preferably in a Non-banking financial institution, a bank or other financial institution and development finance fields.
• Knowledge of laws and regulations applicable to NBFIs in India;
• Excellent communication skills, verbally as well as written.
• Computer literacy
• A quick learner, a self-starter, focused on delivering results and bring a lot of positive energy to the team.
