Job Description

Key Responsibilities:

  1. Regulatory Compliance:
    • Ensure the NBFC complies with all regulations and guidelines set by regulatory bodies such as the Reserve Bank of India (RBI), Securities and Exchange Board of India (SEBI), and Financial Intelligence Unit (FIU).
    • Monitor regulatory changes and assess their impact on the companys operations.
    • Liaise with regulators and government authorities during audits and inspections.
  2. Policy and Procedure Development:
    • Develop and implement internal policies and procedures that comply with legal requirements and industry standards.
    • Regularly update compliance frameworks to reflect changing laws and regulatory practices.
  3. Risk Management:
    • Identify and assess compliance risks and propose mitigation strategies.
    • Conduct regular compliance audits and risk assessments to identify potential areas of concern.
    • Ensure appropriate actions are taken to address non-compliance issues or any breaches.
  4. Compliance Reporting:
    • Prepare and present compliance reports to senior management, the Board of Directors, and regulators.
    • Keep management informed about any compliance-related issues, penalties, or actions required to rectify breaches.
  5. Training and Awareness:
    • Conduct regular training sessions for employees on compliance matters, ethics, and company policies.
    • Raise awareness about the importance of compliance and its role in the organization’s success.
  6. Internal Control Systems:
    • Oversee the internal control framework and ensure it is adequate to prevent compliance risks.
    • Collaborate with internal audit teams to evaluate the effectiveness of internal controls.
  7. Investigations and Remediation:
    • Lead investigations in case of suspected non-compliance, fraud, or misconduct.
    • Coordinate remediation efforts and ensure corrective actions are taken.
  8. Third-Party Compliance:
    • Ensure that third-party vendors and partners comply with regulatory requirements and internal policies.
    • Perform due diligence on potential third-party relationships to identify any compliance risks.
  9. Corporate Governance:
    • Promote strong corporate governance practices and ethical behavior within the organization.
    • Advise senior management and the board on compliance-related matters.

Skills & Qualifications:

  • Educational Background:
    • A degree in law, finance, business administration, or a related field.
    • Professional certifications in compliance or risk management (e.g., Certified Compliance Professional, Certified Risk Manager) are often preferred.
  • Experience:
    • A significant number of years (usually 10+ years) in a compliance or legal role, preferably within an NBFC or a financial institution.
    • Proven experience in interpreting and implementing regulatory requirements specific to NBFCs.
  • Key Skills:
    • Strong knowledge of regulatory frameworks, including the RBI guidelines, SEBI regulations, FEMA, and Anti-Money Laundering (AML) laws.
    • Excellent understanding of risk management practices and financial regulations.
    • Analytical mindset with strong attention to detail.
    • Good interpersonal and communication skills for dealing with regulators, senior management, and other stakeholders.
    • Leadership abilities to manage compliance teams and drive a culture of compliance within the organization.
  • Soft Skills:
    • Integrity and ethical decision-making skills.
    • Ability to work under pressure and handle complex compliance issues.
    • Strong organizational and multitasking abilities.
