Deliver legal support and advice in respect of AFG activities generally across multiple offices in the UK and Channel Islands, including but not limited to all Consumer Credit Act (CCA) and FCA regulatory requirements and predominantly in relation to motor finance.
Advice, support and liaison with AFG and Mann Island Complaints on complex complaints, in particular relating to motor finance commission.
Advice, support and liaison with AFG Legal and external counsel as appropriate in relation to general funder/dealer/customer/supplier litigation and, specifically, in relation motor finance commission claims.
Provide effective legal advice/oversight and support in relation to: a. Transaction documentation such as HP, PCP, lease and loan financing agreements, security documents etc. b. Back-book related matters including regulatory advice, problematic complaints and litigation; c. New products; d. Policies and procedures; e. Legal documentation including NDAs, terms and conditions and client documentation; f. Effective management information for stakeholders.
Prepare contractual documentation with the business and, where instructed, with external lawyers.
Identify legal risks with consideration to internal credit requirements.
Assist in various capacities with the delivery of AFG transactions and projects, special initiatives, new products, issues resolution or business opportunities.
Liaise with AFG and MIF Compliance to ensure adherence to AFGs regulatory obligations and implementation of new initiatives.
Ensure the AFG platforms (e.g. contractual templates) have a robust legal risk environment, review new documentation (including third party intermediary contract templates) and maintain accurate records.
Other ad hoc legal support for AFG as the case may be from time to time.
Assist AFGs data protection function, informing and advising the business about its obligations with regard to data protection law.
Attend key business forums.
What are we looking for
Regulatory knowledge as applicable to role: CCA, data protection law, FCA regulation, FOS, contractual law, consumer law (including Consumer Rights Act 2015) and working knowledge and experience in asset finance and commercial documentation.
Relationship Management and communication: ability to create and maintain strong relationships with key interfaces especially, external lawyers, introducers, front office and team members.
Risk Understanding: Ability to assess and interpret legal risks.
Any other attributes that would be helpful, but not essential for the role
Experience in the motor finance sector, specifically in relation to commission and satisfactory quality disputes.
